By accessing or using the GovCon SkyNet platform at govconskynet.com (the "Service"), operated by Mittkin LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

GovCon SkyNet is an AI-powered platform that helps businesses discover, analyze, and respond to government contracting opportunities. The Service includes opportunity search and matching, AI-generated proposal content, compliance analysis, and proposal tracking.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

The Service is offered on a subscription basis at the pricing displayed on our website. A free trial period may be offered to new users. You agree to pay all fees associated with your subscription plan. Fees are non-refundable except as required by law or as expressly stated in these Terms.

5. AI-Generated Content Disclaimer

THE SERVICE USES ARTIFICIAL INTELLIGENCE TO GENERATE PROPOSAL MATERIALS, COMPLIANCE ANALYSES, MATCH SCORES, BID RECOMMENDATIONS, AND OTHER CONTENT. ALL AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL AND DRAFTING ASSISTANCE PURPOSES ONLY AND DOES NOT CONSTITUTE LEGAL, FINANCIAL, OR PROFESSIONAL ADVICE.

You are solely responsible for reviewing, verifying, editing, and approving all AI-generated content before submitting it to any government agency, contracting officer, or other party. We make no representation that AI-generated content is accurate, complete, compliant with applicable regulations, or suitable for submission.

6. No Guarantee of Results

We do not guarantee that use of the Service will result in the award of any government contract. Match scores, compliance assessments, bid/no-bid recommendations, and opportunity analyses are algorithmic estimates and should not be relied upon as the sole basis for business decisions. Past performance on the platform does not predict future contract awards.

7. Your Data

You retain ownership of all data, content, and materials you upload to or create through the Service ("Your Data"). By using the Service, you grant us a limited license to process Your Data solely for the purpose of providing the Service to you. We will not use Your Data to train AI models. 8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations
• Submit false or misleading information to government agencies using content generated by the Service
• Attempt to reverse-engineer, decompile, or extract the source code or algorithms of the Service
• Share your account credentials with unauthorized users
• Use automated tools to scrape or extract data from the Service beyond normal usage
• Interfere with or disrupt the Service or its infrastructure
• Resell or redistribute the Service without our written consent

9. Intellectual Property

The Service, including its scoring algorithms, user interface, and proprietary technology, is owned by Mittkin LLC and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service. AI-generated content produced for you through the Service is yours to use, but the underlying technology remains ours.

10. Third-Party Services

The Service integrates with third-party services including SAM.gov, Anthropic (Claude AI), and Google (authentication). We are not responsible for the availability, accuracy, or policies of these third-party services. Government opportunity data is sourced from SAM.gov and we do not guarantee its accuracy, completeness, or timeliness.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MITTKIN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITIES, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total aggregate liability shall not exceed the amounts paid by you in the twelve (12) months preceding the claim. This limitation applies regardless of the theory of liability and even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mittkin LLC, its officers, members, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your submission of proposals or materials to government agencies, your violation of these Terms, or your violation of any law or regulation.

13. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue features of the Service at any time. We are not liable for any damages resulting from service outages, API rate limits, or technical disruptions beyond our reasonable control.

14. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. We may retain Your Data for a reasonable period to comply with legal obligations, after which it will be deleted.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of laws principles. Any dispute arising under these Terms shall first be subject to good faith negotiation. If unresolved within thirty (30) days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, held in Northern Virginia.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
